EC PHARMACY UPDATE

There is currently no legislative activity in the state around EC pharmacy access.

The political climate in Oklahoma has not been receptive to EC in general. A Reproductive Health Coalition of pro-choice agencies led by Planned Parenthood in Tulsa surveyed pharmacies and found dedicated EC products are not generally stocked. Members of the coalition (including Religious Coalition for Reproductive Choice, Oklahoma American Civil Liberties Union (ACLU), Primary Care Association, Reproductive Services for Women, Progressive Alliance, NARAL Pro-Choice Oklahoma, etc) are exploring legislative or regulatory means to work with the pharmacy association and is beginning to see what kind of statewide initiative can be pursued.

Some training on EC for health care professionals has occurred. The Association of Reproductive Health Professionals did a “train the trainer” program. Planned Parenthood of Central Oklahoma subsequently conducted 10 trainings reaching Oklahoma University College of Pharmacy, nurse practitioners, medical students, and other health care providers in the metro Oklahoma City and Tulsa areas.

PROTOCOL ENVIRONMENT

Possible Environment: Revision to Existing Authority Required

This state permits collaborative practice agreements or a similar agreement between physicians and pharmacists. However, some modification of existing statutes and/or regulations is required to allow pharmacists to initiate EC for the general community.

Pharmacist initiation of EC would require:

  • Modifying the Pharmacy Practice Act to authorize pharmacists to administer emergency contraception
  • Modifying the requirement for patient-specific "orders"
  • Promulgation by the Board of Pharmacy of EC training requirements for pharmacists

Pharmacy Practice Act Regulatory and Statutory Authority

Note: The text presented below has been prepared by the American Pharmacists Association for the Pharmacy Access Partnership and reflects legislation or regulation promulgated as of June 15, 2003.

OKLAHOMA

While the definition of “practice of pharmacy” includes “administering drugs,” Oklahoma has no statute or regulation that provides for collaborative drug therapy management, which makes the provision of emergency contraception by pharmacists problematic.

Recently the state legislature did amend the Pharmacy Practice Act to authorize pharmacists to administer immunizations, by any route of delivery, to an individual pursuant to a patient-specific order from a physician or osteopath. The Board of Pharmacy, in consultation with the Boards of Medicine and Osteopathic Medicine, is charged with promulgating regulations implementing this section that shall include specified training prerequisites.

On May 28th, the Governor signed into law a bill that explicitly enables pharmacists to administer “therapeutic injections” as well, again pursuant to a patient-specific order and after the completion of training to be defined by Pharmacy Board regulation. Presumably, this includes injectable contraceptives, but would not include oral emergency contraception.

<353.30> A. The use of agreements in the practice of pharmacy shall be acceptable within the rules established promulgated by the Board of Pharmacy and in consultation with the State Board of Medical Licensure and Supervision and the State Board of Osteopathic Examiners.

B. The Board of Pharmacy shall develop and prepare permanent rules relating to training requirements and administration of immunizations and therapeutic injections in consultation within the State Board of Medical Licensure and Supervision and the State Board of Osteopathic Examiners.

C. A pharmacist who has completed a requisite course of training as approved by the Board of Pharmacy in consultation with the State Board of Medical Licensure and Supervision and the State Board of Osteopathic Examiners, may administer immunizations and therapeutic injections only on upon patient specific orders from an osteopathic physicians physician or allopathic physicians physician.

D. In the case of both immunization and therapeutic injection to be administered by a pharmacist, the required patient specific prescriptions shall be written in accordance with rules promulgated by the licensing board of the licensed practitioner issuing the prescription.

SECTION . It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval.
